Release of Liability and Photography Waiver Contract

Please review and sign the following contract prior to our session.

*SESSION INFORMATION – The Creative fee is non-refundable and due at the time of booking. Creative fee covers the time and talent of the photographer and does not include prints, digital files or products. Sessions requiring more than 30 miles of drive time from Roswell will be charged an additional travel fee. If the photographer cannot perform this contract due to personal reasons, the photographer will reschedule the session and and in the event that the photographer is unable to reschedule the session, Freckled Flower Photography will return any deposit or session fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client’s order.

*PROOFING AND ORDERING – Within approximately two weeks of the session, an email will be sent linking you to a gallery of edited images. Images are selected and edited at the photographers’ discretion. The artist reserves the right to edit and release only those images deemed creditable as professional in quality and within the photographers’ artistic standards. The photos will be available for viewing, downloading and purchasing, in a password protected gallery for 2 weeks. Images are kept on file for 3 months after the session. Every effort is made to secure equipment back-up, however due to the unreliability of digital equipment, data loss can occur at any time; except as explained herein, photographer shall not be liable for any loss of digital data whatsoever.

*WAIVER OF LIABILITY: Client expressly releases Freckled Flower Photography from all claims, damages, and liabilities that may result from accidents or incidents that occur during the portrait session. Photographer is not responsible for damage or loss to person or property that may result from the photography session itself or anything related to the photography session.

*IMAGES AND COPYRIGHTS- The photographs produced by Freckled Flower Photography may not be reproduced in any manner without explicitly written permission from Freckled Flower Photography. Upon final payment, CLIENT has limited copyright ownership of the resulting images, which may be for personal use only. This permission is included with flash drives and CDs, with which the owner may make prints for personal use and sharing, as well as use for their personal blogs, sites, and social networks. Photographs may not be otherwise copied, scanned, printed, shared, altered, or otherwise uploaded/downloaded without express permission of Freckled Flower Photography. CLIENT must obtain written permission from, and compensate Freckled Flower Photography prior to the CLIENT, or any Third Parties, publishing, selling, or redistributing the images for profit.

*MODEL RELEASE – Freckled Flower Photography reserves the right to use images created under this contract for advertising, display, publication or other purposes. The CLIENT signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Freckled Flower Photography in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of Freckled Flower Photography.
